Welcome to Fluixio Technologies Private Limited (“Fluixio”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of all software applications, websites, cloud services, APIs, integrations, products, and related services operated by Fluixio Technologies Private Limited (collectively, the “Services”), unless a product-specific agreement expressly states otherwise.

By accessing or using any Fluixio Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Services.

You represent and warrant that:

• You have the legal authority to enter into these Terms.
• You are at least the age of majority under applicable law.
• If you use the Services on behalf of an organization, you have authority to bind that organization.

These Terms apply to all current and future Fluixio products, unless a product-specific agreement states otherwise:

You are explicitly responsible for maintaining accurate account information, keeping login credentials secure, and managing all activities performed using your account. You must promptly notify Fluixio of any unauthorized access.

Note: Fluixio is not responsible for losses arising from unauthorized use of your credentials.

We continuously improve our Services. Accordingly, we reserve the right to add new features, modify functionality, remove features, release beta functionality, fix bugs, and improve security without prior notice where reasonably necessary.

Certain Services require a paid subscription. Subscription plans, pricing, included features, and billing cycles are described transparently on the applicable product page. Different products may feature independent pricing, trial options, and feature configurations.

The availability, duration, and eligibility of any trial are determined individually for each product and may change without notice. Fluixio reserves the right to modify or discontinue trial programs at any time.

Paid subscriptions may be billed monthly, quarterly, annually, or using another billing interval specified for the applicable product. Subscription charges are payable in advance unless otherwise stated.

Customers may cancel recurring subscriptions at any time through the available subscription management dashboard. Cancellation prevents future automatic renewals. Unless stated otherwise, cancellation does not immediately terminate access; you will continue to have access until the end of the current paid billing cycle.

All applicable taxes, duties, governmental charges, and payment processing fees remain the exclusive responsibility of the customer.

Refund eligibility varies by product. Applicable refund terms are described in the relevant product documentation and the Fluixio Refund & Cancellation Policy. Unless explicitly stated otherwise, subscription payments are non-refundable.

You strictly agree not to misuse our infrastructure. Explicitly forbidden actions include:

Customers retain complete ownership of their own business data, profiles, and processed metrics. Fluixio receives only the limited, temporary operational infrastructure access rights required to seamlessly host and run the requested platform features.

Certain Services integrate directly with external platforms. By authorizing such integrations, you grant Fluixio permission to access only the information configuration required to provide the requested pipeline feature. Use of third-party networks remains fully subject to the compliance terms of those specific providers.

While Fluixio strives to maintain highly dependable architectures, uninterrupted availability cannot be guaranteed. Scheduled system tuning, emergency maintenance, infrastructure network drops, and global ISP disruptions may temporarily cause temporary system downtime.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Fluixio explicitly disclaims all warranties, whether express, implied, or statutory, including implied merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Fluixio shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, revenue, business opportunities, or data loops). Where liability cannot be completely excluded by law, Fluixio's cumulative liability loop shall not exceed the total amount paid by the customer for that specific Service during the twelve (12) months immediately preceding the claim event.

You agree to indemnify, defend, and hold harmless Fluixio, its directors, officers, employees, affiliates, and partners from any third-party claims, liabilities, damages, losses, or legal expenses arising directly from your misuse of the platform services, violation of these Terms, or infringement of third-party security layers.

Fluixio may temporarily suspend or permanently terminate access lines where reasonably necessary, including scenarios regarding violation of these Terms, suspected client fraudulent activity, outstanding payment failures, or where continuing access poses a critical platform threat vector.

Fluixio shall not be held liable for delays or operational execution failures caused directly by environmental factors beyond its reasonable control, including natural disasters, war, infrastructure blockages, labor disputes, tier-1 cloud network dropouts, government bans, or pandemics.

Your access parameters and data tracking layouts are concurrently governed by the unified Fluixio Privacy Policy.

Fluixio may revise these Terms from time to time. Updated versions become fully effective upon public upload. Continued interactions with our ecosystem services past the update date constitute complete acceptance of the updated Terms.

These Terms shall be exclusively governed by and interpreted in absolute alignment with the laws of India. Subject to applicable regulatory constraints, courts located in Gautam Buddha Nagar, Uttar Pradesh, India shall hold exclusive legal jurisdiction over any resulting disputes.

If any single clause is found unenforceable by a court of competent authority, remaining independent segments shall remain in complete force. These Terms, combined with the Privacy Policy, Refund Policy, and custom service level descriptions, represent the comprehensive entire agreement between the entities.
